AUKCIONO LAIMĖTOJO REPUTACIJOS IR NACIONALINIO SAUGUMO PATIKRA

Informuojame, kad pasibaigus aukcionui, Aukciono dalyvis pasiūlęs didžiausią Aukciono kainą, bus įvertintas dėl reputacijos, finansinio stabilumo ir kitų kriterijų, kurie leis užtikrinti tinkamą sutarties vykdymą, taip pat atitiktį LTG įmonių grupėje galiojančioms politikoms, iš jų atitikties sankcijų ir nacionalinio saugumo reikalavimams.

Didžiausią kainą pasiūlęs Aukciono dalyvis arba vienintelis užsiregistravęs Aukciono dalyvis, kuris pasiūlė pradinę parduodamo turto kainą, gali būti Turto savininko nepripažintas Aukciono laimėtoju ir Turto savininkas gali atsisakyti sudaryti su juo Pirkimo–pardavimo sutartį, jeigu:

1.1 Pardavėjui įvertinus Aukciono dalyvio reputacijos, finansinio stabilumo ir kitus kriterijus, kurie leis užtikrinti tinkamą sutarties vykdymą, arba atlikus vertinimą pagal LTG įmonių grupės galiojančias politikas, iš jų atitiktį sankcijų ir nacionalinio saugumo reikalavimams, bus nustatytos aplinkybės, keliančios pagrįstas abejones dėl Aukciono dalyvio reputacijos ir tinkamo sutartinių įsipareigojimų vykdymo.

1.2 Nacionaliniam saugumui užtikrinti svarbių objektų apsaugos koordinavimo komisijai (toliau – NSK), kaip numatoma Lietuvos Respublikos nacionaliniam saugumui užtikrinti svarbių objektų apsaugos įstatymo 12 straipsnyje, atlikus ketinamos sudaryti su Aukciono dalyviu sandorio patikrą, pateiks išvadą, kad sandoris su Aukciono dalyviu kelia riziką nacionalinio saugumo interesams ar neatitinka nacionalinio saugumo interesų.

Turto savininkas, atsisakydamas sudaryti sutartį su Aukciono laimėtoju, neprivalo kreiptis į kompetentingas Lietuvos Respublikos ar užsienio institucijas ar įstaigas dėl Sąlygų punktuose nurodytus kriterijus pagrindžiančios informacijos ir neprivalo pateikti Aukciono dalyviui jokių pažymų ar kitų įrodymų, pagrindžiančių šią Turto savininko turimą informaciją.

Turto savininkas bet kuriuo momentu iki Aukciono dienos turi teisę dėl bet kokių priežasčių nutraukti Aukciono vykdymą.

VERIFICATION OF THE REPUTATION AND NATIONAL SECURITY OF THE AUCTION WINNER

We inform you that after the end of the auction, the Auction Participant who offered the highest Auction price will be evaluated for reputation, financial stability and other criteria that will ensure proper execution of the contract, as well as compliance with the policies in force in the LTG group of companies, including compliance with sanctions and national security requirements.

The Auction Participant who offered the highest price or the only registered Auction Participant who offered the initial price of the property being sold may not be recognized by the Property Owner as the Auction Winner and the Property Owner may refuse to conclude a Purchase and Sale Agreement with him/her if:

1.1 After the Seller has assessed the Auction Participant's reputation, financial stability and other criteria that will ensure proper performance of the contract, or after conducting an assessment in accordance with the valid policies of the LTG Group of Companies, including compliance with sanctions and national security requirements, circumstances will be identified that raise reasonable doubts about the Auction Participant's reputation and proper performance of contractual obligations.

1.2 The Commission for the Coordination of the Protection of Objects Important for Ensuring National Security (hereinafter referred to as the NSK), as provided for in Article 12 of the Law of the Republic of Lithuania on the Protection of Objects Important for Ensuring National Security, after conducting an inspection of the transaction intended to be concluded with the Auction Participant, will submit a conclusion that the transaction with the Auction Participant poses a risk to national security interests or does not comply with national security interests.

The Property Owner, refusing to conclude a contract with the Auction Winner, is not obliged to contact the competent institutions or bodies of the Republic of Lithuania or foreign institutions for information substantiating the criteria specified in the Clauses of the Conditions and is not obliged to provide the Auction Participant with any certificates or other evidence substantiating this information held by the Property Owner.

The Property Owner has the right to terminate the Auction for any reason at any time prior to the Auction Day.
